Terms and Conditions

Welcome to our website. By accessing or using this website and purchasing products or services from us, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully.

By renting a dumpster from Navco Disposal, the customer agrees to be bound by these Terms and Conditions. These Terms apply to all rentals regardless of whether the order is placed online, by phone, email, text message, or in person.

2. Rental Period and Extensions

The rental period begins upon delivery of the dumpster and ends when the dumpster is removed by the Company.

Extension requests must be made at least twenty-four (24) hours prior to the scheduled pickup date and are subject to equipment availability. Approved extensions will incur additional daily rental charges.

The Company reserves the right to remove any dumpster upon expiration of the agreed rental period.


3. Delivery, Placement, and Property Conditions

Customer is solely responsible for providing accurate placement instructions and ensuring the designated location is suitable for delivery and pickup.

Customer warrants that all surfaces, driveways, parking areas, and access routes are capable of supporting the weight of the dumpster and hauling equipment.

The Company shall not be liable for damage to driveways, sidewalks, curbs, lawns, landscaping, underground utilities, sprinkler systems, septic systems, pavement, or other property resulting from the weight, placement, delivery, servicing, or removal of the dumpster.

The Company reserves the right to refuse delivery, relocate equipment, or discontinue service if site conditions are unsafe or inaccessible.

4. Site Access and Dry Run Fees

Customer shall maintain safe, clear, and unobstructed access to the dumpster at all times.

Driveways and access routes must remain free of vehicles, equipment, debris, locked gates, snow, low-hanging branches, or other obstructions.

If the Company is unable to complete a scheduled delivery, exchange, or pickup due to circumstances within the Customer's control, the Customer shall be responsible for all applicable Dry Run Fees, return-trip charges, and additional rental fees.

5. Equipment Use and Customer Responsibilities

The Customer is responsible for the dumpster from the time of delivery until pickup by the Company.

Customer shall not:

  • Move, relocate, alter, modify, or tamper with the dumpster.
  • Allow any person or company other than Navco Disposal to transport or relocate the dumpster.
  • Burn materials in the dumpster.
  • Use the dumpster for any unlawful purpose.
  • Overload the dumpster beyond the fill line.
  • Place prohibited materials in the dumpster.

Unauthorized movement of the dumpster may result in immediate fines, service termination, and liability for all resulting damages, recovery costs, and repairs.

6. Loading Capacity and Safety Requirements

All materials must be loaded evenly and remain level with the top rim of the dumpster.

The Company will not transport any dumpster that is overloaded, improperly balanced, or otherwise unsafe for transport.

If excess debris must be removed before pickup, the Customer shall immediately correct the condition. Daily rental charges will continue to accrue until the dumpster can be safely removed.

The Customer shall be responsible for all overload fees, return-trip charges, and additional rental fees resulting from unsafe loading conditions.

7. Weight Limits and Overweight Charges

Weight allowances are included as follows:

  • 10-Yard Dumpster: 1 Ton Included
  • 20-Yard Dumpster: 2 Tons Included
  • 30-Yard Dumpster: 3 Tons Included

Any weight exceeding the included allowance will be billed at the Company's current overweight rate per ton, or prorated portion thereof.

Certified landfill or transfer station scale tickets shall serve as the final and binding determination of weight.

8. Prohibited Materials and Contamination Fees

The following materials are strictly prohibited:

  • Hazardous waste
  • Chemicals
  • Asbestos-containing materials
  • Medical waste
  • Flammable liquids
  • Gasoline, diesel fuel, and petroleum products
  • Paints, solvents, and thinners
  • Propane tanks and pressurized containers
  • Batteries
  • Electronics
  • Tires
  • Refrigerators and major appliances unless approved in advance
  • Radioactive materials
  • Any material prohibited by federal, state, or local law

Heavy materials including dirt, concrete, brick, asphalt, stone, gravel, masonry, and roofing materials must be disclosed before delivery and may require specialized containers.

If prohibited or contaminated materials are discovered, Customer shall be solely responsible for all environmental fines, disposal fees, sorting charges, transportation costs, cleanup expenses, reload fees, regulatory penalties, and related costs incurred by the Company.

9. Payment Authorization and Fees

By providing a credit or debit card, Customer authorizes the Company to charge the card for all amounts due under this Agreement, including but not limited to:

  • Rental charges
  • Delivery and pickup fees
  • Additional rental days
  • Overweight charges
  • Overload fees
  • Dry Run Fees
  • Return-trip charges
  • Prohibited material charges
  • Environmental or contamination fees
  • Repair costs
  • Replacement costs
  • Collection costs

Cancellation requests made within twenty-four (24) hours of the scheduled delivery date may be subject to a Cancellation Fee.

Any unpaid balance may be submitted for collection, and Customer shall be responsible for all collection costs, court costs, and reasonable attorney's fees permitted by law.

10. Permits and Compliance

Customer is solely responsible for obtaining all permits, licenses, parking permits, variances, homeowner association approvals, and governmental authorizations required for dumpster placement.

The Company assumes no responsibility for fines, citations, towing fees, permit violations, or enforcement actions resulting from the Customer's failure to obtain required approvals.

11. Equipment Damage, Theft, Fire, and Loss

Customer assumes full responsibility for the dumpster during the rental period.

Customer shall be liable for any damage beyond normal wear and tear, including but not limited to:

  • Fire damage
  • Structural damage
  • Graffiti
  • Damage caused by heavy equipment
  • Vandalism
  • Theft
  • Total loss or destruction of equipment

Repair or replacement costs shall be determined by the Company and billed to the Customer.

12. Limitation of Liability

Under no circumstances shall Navco Disposal be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from the delivery, placement, use, servicing, or removal of any dumpster.

The Company's maximum liability for any claim shall not exceed the amount paid by the Customer for the rental giving rise to the claim.

13. Indemnification

Customer agrees to defend, indemnify, and hold harmless Navco Disposal, its owners, officers, employees, agents, contractors, and affiliates from and against all claims, losses, damages, liabilities, fines, penalties, costs, and expenses arising from:

  • Customer's use of the dumpster;
  • Improper loading or overloading;
  • Placement location designated by the Customer;
  • Violation of these Terms and Conditions;
  • Violation of any law, ordinance, permit, regulation, or HOA requirement;
  • Personal injury, property damage, or environmental claims arising during the rental period.

14. Governing Law and Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.

Any legal action arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located within the Commonwealth of Virginia.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between Navco Disposal and the Customer and supersede all prior discussions, representations, advertisements, quotations, or agreements.

Navco Disposal reserves the right to amend or modify these Terms and Conditions at any time. Continued use of Company services constitutes acceptance of any revised Terms and Conditions.
